License terms for Rapid-Mosaic Professional

This is a translation. In case of doubt, the German version of these license terms applies.

These terms govern the use of the software RAPID-MOSAIC PROFESSIONAL, hereinafter referred to as the “Software”. They also apply to licenses of Foto-Mosaik-Edda Professional that continue to be used in Rapid-Mosaic. Please read these license terms carefully before you buy, download and/or use the Software.

If you do not agree with these terms, you will not receive a license for the Software. In this case, you are not entitled to use the Software.

1 Ownership

1.1 All rights, title and other legal interests in or relating to the Software (including all copyrights and other intellectual property rights therein) remain with sixdots GmbH, hereinafter referred to as the licensor.

1.2 The Software is not sold but licensed. With regard to the Software, a right of use is acquired in accordance with the following terms.

2 Granting of the license

2.1 After the purchase you will receive an email with the license at the email address you provided. The license is contained in a file in which your name and email address are encoded with the license key. The license file is loaded in Rapid-Mosaic under Settings › License and unlocks the Professional features; without it, Rapid-Mosaic runs as the free Standard version.

2.2 A license may either be used by one individual for personal use on up to 2 permanently assigned computers, but not simultaneously, or it may be installed on a single computer only and used by several people simultaneously. Otherwise you need as many licenses as there are computers and clients on which the Software is available for execution. If you have purchased several licenses for the Software, no more copies may be in use at any time than the number of licenses you have purchased.

2.3 If an installation of the Software is available for execution over a network, the number of your licenses for the Software must be greater than or equal to the number of physical computers, servers and terminal clients on which it is executed.

3 Restrictions of the license

3.1 You are not entitled to pass on the Software, the license file or associated written material to third parties or to make it accessible in any other way without the prior written consent of the licensor.

3.2 Using the Software on several computers without a license or distributing it without authorization via file-sharing networks and similar internet media will be prosecuted under civil and criminal law.

3.3 You are not entitled to reverse engineer, decompile or disassemble the Software, or to alter or remove copyright notices or trademarks.

3.4 The Software is licensed as a single product. You are not entitled to separate the components of the Software in order to use them on more than one computer.

3.5 You are not entitled to rent or lease the software product.

4 Warranty

4.1 Any warranty that the Software is suitable for the user’s purposes and works with software or hardware existing at the user’s site is excluded.

4.2 The licensor points out that, according to the state of the art, it is not possible to produce computer software completely free of errors.

5 Updates

5.1 The licensor is entitled, but not obliged, to publish updates of the Software.

6 Miscellaneous

6.1 If parts or individual wordings of this license agreement do not, no longer or not completely comply with the applicable law, the remaining parts of the agreement remain unaffected in their content and validity. In such a case, the parties undertake to make a corresponding effective supplementary agreement.
